I had a local company run 3 adverts for me in their magazine. Now the first advert the were meant to sent me a proof for me to agree which they never did and the advert came out totally the wrong colour. The second went into the wrong area, and the third was fine. Now they want paying for 3 adverts. I said im happy to pay for 2 of them even though one was in the wrong area. Now the guy said he get a debt collection company involved for the full amount. Each advert is £72 Should i pay him for two or let him chase me for the full amount. Should i take legal advice?
 
was this a weekly advert, as in the add went in three seperate weeks, if so did you ring them when you noticed the first add was wrong.
 
Quarterly adverts so yes i did ring them, they have only just sent me the invoices for Winter 2010, Summer 2010 and spring 2011. They are annoyed as i have stopped advertising with them.
 
Do you have any emails from them saying what they would do for the money? including proofs?

I would fight them, I would also only pay for one ad as that is the only one which was correct.

If you agreed to tile 3 walls in someones bathroom, tiled 1 wall in the wrong tiles, tiled one wall next door by accident, then finally got the last wall right. What would you expect to get paid for?

No i dont not have proofs. I have said if they can show me the confirmation of the proof i will pay.
 
if they agreeded to show you a proof of the add b4 going to print, and they didnt , then i dont think they have a leg to stand on.
 
If you had an agreement of what was to be published and that agreement was broken you are the person with the high ground. If they have given you a service other than that agreement they have no right to complain. If mistakes have been made on their part you are the customer, if there is no written or verbal agreement and a sign off of the final print, you have nothing to worry about.
 
Pay for one and fight the other 2 as they were incorrect.... Come to think of it... I wouldn't pay for any, as you asked for three adverts that were ment to be the same and be in the right category to build familiarity with the readership, for which they failed to deliver......
 
Did you get any work from the ads or were the mistakes a relavant factor in a poor return?
OR
With the log you kept from the enquiries generated, show them that it was the correct advert that provided the only replies.
I'd pay for the correct ad only as a sign of commitment on your behalf.

That is so true of printed media, in fact many advertising agencies will tell you the same when trying to sell their services
 
Just to add to what I said, I had an agreement with my local paper that for *** I would have a Colour advert for the week, and it was black and White, I complained that they hadn't fulfilled the agreement I got another week for free. Email or writing, there needs to be a contract of some sort.
 
i would'nt pay at all untill i sought legal advice. by paying for one you may be admitting you owe the money. the c.a.b. will give you good free advice
