CJ, as has been mentioned get legal advice. You can go to the CAB but in my experience its of limited benefit. So my advise is this. Check your house insurance and or your PLI to see if you have legal cover. If you have contact them immediatly. Small claims will cost you more then you'll recover, not the court themselves but the cost of a legal team and ultimatly I'd suggest that it wont stop at small claims.

So check your insurance policies now!
 
well, i've read your post several times now, and still can't believe what i'm reading. is this guy winding you up or something? i've never heard of something like this before, and just reading about it is giving me the right hump. hope you get what you're owed and he gets knocked over by a bus.

i just wish them to hire a cowboy next time
 
He has actually committed fraud which needs to be reported to the police IMO. The customer clearly had no intention to pay. He has obtained your services dishonestly. Simple as that
 
Unbelievable, this guy deserves ALL he gets.......and more. As for the plasterer.......I hope his next poo is a hedgehog
 
So wrong on all levels, but how this country is, I'd suspect there are more laws protecting this customer than CJ🙁
 
It's at times like this that I would dream of having access to a debt collector like Barry the Baptist from Lock Stock and Two Smoking Barrels.

Just out of interest why could you only work between the hours of 10-2.

Hi whitebeam the reason the customer stated that i could only work 10-2 was that he had a business that he opened at 7 and then came home at 10 and then went back to close the business leaving home at 2 and did not feel comfortable leaving people in his house unattended (he did say that this was all workmen and was not in any way aimed solely at me). On 2 days upon arriving at the job his wife was also present due to days off from work and still i had to leave at 2. Not sure what he thought i was going to do.

I would like to thank you all for your thoughts comments and advice in regards to this matter. I have taken note of the advice and shall be acting accordingly, although i do feel that actually reclaiming the money even after a court case may be near impossible as i now feel that this customer does know the legal stand points and has basically played me. but i will see this through to the bitter end no matter what.

i would also like to make you all a promise.......after reading through some of my recent posts it seems that i have had a run of bad luck in the past couple of months BUT there have also been some good times aswell, So i promise that the next post from myself will a happy one:hurray::lol:

I don't think a phone call to a solicitor would cost you anything, Chris. Then you can let us all know where we would stand as it could happen to any one of us :thumbsup:
 
I spoke to a local solicitor over the weekend on a purely off the record basis....his son plays football with mine, and although he himself does not deal with this sort of matter he is going to ask his parteners for me to find out the best coarse of action and will let me kow at football training this week. So i will keep you informed as to what he has for me.

i hope justice is done chris but i still believe you should not have left the house so easy. you should have started lifting tiles to get YOUR adhesive back. i'm sure he would have seriously thought about paying you then. good luck with it mate

Bit difficult though when there was already a police complaint about a non-existing assault! To me that's the most upsetting thing of all, what a grotty evil trick to pull ... :thumbsdown: Adding vandalism to someone's private property wouldn't have helped at all... keep thinking about it... you've got us all rooting for you, Chris... what a shocker.
 
smashing the tiles would have been vandalism but carefully removing them to retain your own property (addy and grout) would have been ok. i had an incident with a bad next door neighbour were they removed my edgings from my garden cos they didn't llike the look of them. i called the police who said it was a civil matter and as there's no damage to the edgings there's nothing they could do. i waited till they went away for the weekend and laid them again with re bar through them and fast drying concrete, result :lol::lol:

Its typical of the way this country is heading, personally I would send the boys around, but this scumbag sounds like he knows exactly what he is doing, so ya gotta tread careful & as mentioned by others, from a distance.
The missus read it too & she was gobsmacked too she said same as Pebbs suggested, send final invoice registered post.
Hopefully will get sorted.
As for ya so-called mate, he'd be getting a clip big style.

Why does the vindictive hackles on my neck start twitching when I re-read this.

If no above board methods are suitable, I (and this is just my view) would be taking slightly dodgy methods to cost them more in the long run.

As I said............this is my view, because I just cannot stand this sort of thing.

I second this emotion, its not vindictive, its fighting fire with fire, when something is so wrong, a piece of paper doesnt hit the spot. This scumbag would have been given a good clump a few years ago...and learnt his lesson.

As stated above i would send a 7 day to pay final bill by recorded delivery, on the 8th day again by recorded delivery send a ''if not paid within 5 days the matter will go to small claims court''.

I would also write on a piece of paper or a notebook that you carry, the conversation you had with him at the time, as clear as you remember it, in a
''I said this'' = ............................ and
''he said that'' = ............................
fashion, also include what the police said, the fuller the conversation the better, this could be used in a court as a true conversation, a bit like police notes made at the time. the sooner you make the notes the better, (made at the time after the police left would have been the 'best evidence'), dated and timed the 'best evidence', you could include a copy of these 'made at the time notes' with your second letter about the court action, when you send it, but this could pre-warn him that you have the notes, so needs thinking about. He will not have notes made at the time, so the court should accept your version as more accurate.

I think he would have committed 'obtaining service by deception' under the theft act. or a similar offence, so may be worth speaking to local police and if possible CID, but they may be lough to take action, but it would counteract the fact that he called the police about threatening behaviour.

Don't let him get away with it, some sort of insurance to cover this sort of thing, could be worth looking into as a group cover.

Again i have to say a big thank you to you all for your support, the thought of repaying this customer with kind so that it costs him more than the job was worth has certainly crossed my mind on more than one occasion, but is not really something that i will do as knowing me i will get it all wrong anyway.

the good news for now is that my solictor friend of mine has constructed a nice letter and invoice for me and sent it to the customer explaining that if full payment is not made then court proceedings will actioned against him, using the 2 police officers who attended his call as witness's to the fact the work was completed and to a satisfactory standard. This is as he says just a scare tactic to hopefully push him to pay, but has on other occasions worked successfully. He is not going to charge me anything for this......but did ask if his son could be captain for football on saturday lol.

Keep in touch with your solicitor. I'd consider making his kid captain for the next few weeks even if nothing important is going on with the situation (like waiting for replies or whatever).

Me too. We tend to deal with most of our issues out of court. Both parties always understand it's costly and neither normally have bad intentions.

Which is why I sort of suspect this guy is some type of law guy, solicitor, CPS, police maybe? You know what he does for a living mate?
 
Hes a janitor for local council Dave......but has made a lot of money from doing houses up and selling them (most of his profit probably came from not paying for the work).
 
You mean Dan, not Dave mate.

I see why he's doing that now. You should try to find others he hasn't paid and make this be his big payback time.
 
So sorry Dan i do apologise mate, I will certainly be making his son Captain this week, but in all honesty not just because of what his Father is doing for me, But for the fact Jody (his son not the father) is a new player who signed with us at the beginning of the season and although not the most technical player we have, he is already due to be awarded the MVP award at the end of the season. He is someone who will play in any position i ask him to and gives his utmost everytime.
